Danville Hog farm in middle of right to farm law

A two-year fight over a Danville hog farm is now a challenge to the constitutionality of Indiana’s “right to farm” law. Two Danville couples are suing a nearby hog farm they charge has been stinking up the air so much that they can’t go outside, and sometimes can’t even stand it inside. But along with claiming the farm had a duty to minimize the impact on its neighbors, Hoosier Environmental Council attorney Kim Ferraro argues Indiana’s right to farm law creates an unconstitutional taking of property.
